Terms and conditions of the prize draw

TERMS AND CONDITIONS FOR TAKING PART IN THE “PRIZE DRAW 3 NIGHTS AT SHOLEO LODGES MASPALOMAS”

1.-THE PROMOTION ORGANISER

The company Juan José Fuentes Tabares S.L., with registered address at Calle Puerto Escondido 3, first floor, and number B-38722898, is running an international internet-based prize draw for promotional purposes, for users who are of legal age, in accordance with the terms set out under the section entitled “terms and conditions for taking part”.
This Promotion is being run as part of JFT Comunicación’s work for Canarian Hospitality, S.L. under the agreed services for implementing and managing the Sholeo Lodges account on both Instagram and Facebook social media platforms.

2.START AND END DATES

The Promotion will start on July 24th, 2025, and will end on August 7th, 2025.
The Organiser reserves the right not to proceed with the Promotion if no more than four Participants have registered by the date shown for the start of the Promotion. Where more than five Participants have registered, the Organiser may also extend the end date of the Promotion for 1 further week, with the new end date being August 15th, 2025.

3.-PARTICIPATION REQUIREMENTS AND MECHANICS

It is important to underline that participation in the prize draw implies unconditional acceptance of and respect for these Terms and Conditions.
The requirements for taking part are as follows:

  • The Promotion is open to persons aged 18 and over, residents in Spain, the United Kindom, the Republic of Ireland, Germany, Poland, Italy and Ukraine.
  • Entries will only be considered valid where they are made by Participants who follow @sholeo_lodges on Instagram or Facebook, have liked the post, shared it through stories, and posted a comment tagging or mentioning the person they will be sharing the prize with.

The mechanics of the Promotion consist of posting a comment tagging the person they would like to share this experience with and following @sholeo_lodges on Instagram or Facebook.

4.-PROMOTION AND PRIZES TERMS & CONDITIONS

One winner and three alternates will be drawn by lot on August 8th, 2025. The winners and alternates will be selected randomly using the Easypromos platform. Easypromos is a platform that guarantees transparency in the results of prize draws. By way of proof of this, Easypromos issues a certificate of validity for each of its prize draws, the result of which cannot be altered by the prize draw Organiser, and which Participants can request from the Organiser.
The winner’s Instagram nickname shall be published on Instagram Stories at @sholeo_lodges’ account on August 8th, 2025.
The first winner to be selected will be awarded with 3 nights with breakfast to be taken consecutively in Sholeo Lodges Maspalomas (Avenida de Gran Canaria, 24, 35100, Maspalomas). Flight or ferry tickets, transfer or any other transportation fees are not included in the prize.
The winner can contact the Organiser by email at info@jftcomunicacion.es within 48 hours of the date of the announcement on the brand’s social media profile. The Organiser will also contact the winner at least once within 48 hours and if no such contact can be made within the stipulated period, another winner will be chosen from among the alternates.
The holding of the prize draw and the awarding of the prizes are subject to applicable tax regulations.
Once a winner has been contacted, they must state the dates on which they wish to enjoy their prize, subject to the hotel’s availability.

5.-DISQUALIFICATION AND PENALTIES

If it becomes evident that a Participant is not complying with the Terms and Conditions, or the data they have provided are not valid, their entry will be considered null and void and they will be automatically excluded from the Promotion, and shall lose all rights to the prizes awarded under this Promotion.
The following persons may not participate in the Promotion: (i) employees of either of the companies (JFT Comunicación and Canarian Hospitality) or other entities with legal status; (ii) individuals who directly or indirectly hold shares in the capital of Juan José Fuentes Tabares S.L and Canarian Hospitality; (iii) any other individual who has been directly or indirectly involved in organising this prize draw or has been involved directly 2
or indirectly in preparing or developing it (agency, suppliers, organiser, etc), as well as their relatives.
Prizes are not transferable or subject to change, alteration or compensation at the Participants’ request and cannot be exchanged for any other product or for money.
The Organiser reserves the right to make any changes, suspend or extend this Promotion where there is just cause and with prior notification given in legal form.
The winner will be responsible for any fiscal or tax charges that acceptance of the prize may entail, as well as any other expenses arising from the Promotion that are not expressly assumed by the Organiser under these Terms and Conditions.
Any substantiated claim must be made within FIFTEEN (15) calendar days of the date on which the prize is awarded, by sending an email to info@jftcomunicacion.es. The Organiser reserves the right to replace the prize with another prize of similar characteristics if necessary.

6.- PUBLICATION OF COMMENTS OR OPINIONS

Videos, comments or opinions whose content is considered inappropriate, offensive, abusive or discriminatory, or which could violate the rights of third parties or violate the rules of the Facebook and Instagram platforms will not be allowed. Equally, content or comments will not be permitted where they are aimed at an individual or violate the principles of the right to honour, personal and family privacy, and personal reputation. We are not responsible for any damage caused by comments made by Participants during the Promotion that may at any time offend the sensibilities of other Participants. Any attempt to hinder the smooth running of the prize draw, whether by human intervention or automated means, shall result in the Participant being immediate disqualified and their entry cancelled.

7.-LIABILITY WAIVER

By way of illustration and not limited to the following, the Organiser accepts no responsibility for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the running of this Promotion. Nor do we accept any responsibility for the use made by the Participant with respect to the prize won under this Promotion, and accept no responsibility for any damage or harm of any kind that may be suffered by the Participants, winner or third parties. 3
The Organiser is not responsible for situations of force majeure or acts of God that could prevent the Promotion from taking place or the total or partial enjoyment of the prize. If this Promotion cannot be run, either due to fraud that is detected as part of it, technical errors, or any other reason beyond the Organiser’s control and which affects the normal running of the prize draw, the Organiser reserves the right to cancel, change or suspend the Promotion, including the participation website.

8. INSTAGRAM (where there are Instagram-based promotions)

The Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram and therefore Participants release Instagram from any and all liability for any damages arising from the Promotion.

9. DATA PROTECTION

In its capacity as Data Controller and in accordance with the provisions of EU General Data Protection Regulation 2016/679 (GDPR), the current national regulations applicable to the subject matter and the Information Society and Electronic Commerce Services Act 34/02 of 11 July (LSSICE), Canarian Hospitality is committed to strict compliance with current legislation on the processing of personal data and information security in order to ensure that the collection and processing of data provided by Participants is done under security levels that prevent the loss of or tampering with data.
In its capacity as Data Processor by virtue of running the “prize draw for a total of 16 nights spread across five prizes for the launch of the Sholeo Lodges Los Gigantes” and in accordance with the provisions of EU General Data Protection Regulation 2016/679 (GDPR), the current national regulations applicable to the subject matter and the Information Society and Electronic Commerce Services Act 34/02 of 11 July (LSSICE), Juan José Fuentes Tabares S.L. is committed to strict compliance with current legislation on the processing of personal data and information security in order to ensure that the collection and processing of data provided by Participants is done under security levels that prevent the loss of or tampering with data.
By accepting these Terms and Conditions, the Participant consents to any personal data that they provide as part of participating in this prize draw being incorporated into a file owned by Canarian Hospitality, and transferred to JFT Comunicación as the Data Processor to process the participation in the prize draw and to provide notification of the prize in the event of being drawn as a Winner.
Please note that the personal contact details you provide (name, surname, telephone number and email) will be used for the following purposes:

  • To contact you to verify that you are eligible to take part in the Promotion.
  • To organise and award the prize.
  • To contact you in the event of incidents or changes to the Promotion.

Participants confirm that the personal data provided are true and they acknowledge that they are responsible for notifying the Organiser of any changes to them. The Organiser reserves the right to exclude from this Promotion any Participant who has provided false information. It is recommended to use best endeavours in regard to Data Protection by using security tools. Canarian Hospitality and Juan José Fuentes Tabares S.L. cannot be held liable for the removal, change or illicit loss of data.
Participants have the right to (i) access their personal data, and (ii) request that inaccurate data be corrected or, where appropriate, deleted, (iii) request the restricted limitation of their data, (iv) object to the processing of their data and (v) request their portability. Participants may exercise these rights via by emailing the following address protecciondatos@jftcomunicacion.es, and stating the reason for their request.
Participants may also send their request by post to the following address: Calle Puerto Escondido no3, 1o Piso, 38002 Santa Cruz de Tenerife.
Without prejudice to any other official or judicial remedy, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular within the Member State in which they have their regular residence, place of work or place of the alleged infringement, if they consider that the processing of their personal data is not lawful, as well as if they are not satisfied when exercising their rights.
The Supervisory Authority to which the complaint has been submitted shall inform the person making the complaint about the follow-up and outcome of the complaint.

10. CHANGES

The Organiser reserves the right to change or extend the Terms and Conditions of this Promotion, insofar as it does not prejudice or undermine the rights of those participating in the Promotion.

11. GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed in accordance with Spanish law. The Courts and Tribunals of the province of Santa Cruz de Tenerife will have jurisdiction for resolving any claim or dispute that may arise in relation to the validity, interpretation or fulfilment of these Terms and Conditions.
